Lapsesõbraliku õigusemõistmise avaldumine taastava õiguse protsessis laste perspektiivist
Kokkuvõte
Artikkel tutvustab uurimust, mis käsitleb lapsesõbraliku õigusemõistmise põhimõtete avaldumist vahenduses kui taastava õiguse protsessis laste vaatepunktist. Uuringu tulemustest lähtuvalt tehakse soovitusi lapsesõbraliku õigusemõistmise põhimõtete efektiivsemaks rakendamiseks lastega seotud juhtumites. Andmete kogumiseks intervjueeriti vahenduses osalenud 15 last. Laste kogemustest nähtus, et vahendus on laste jaoks õiglane ja taastav protsess ning võimaldab neil osaleda, olla ära kuulatud, kaasatud ning nende vajadusi arvestada. Seega rakendatakse taastavat õigust Eestis lapsesõbraliku õiguse printsiipidest lähtuvalt ning taastava õiguse kohaldamine omakorda aitab saavutada lapsesõbraliku õiguse eesmärke. Küll aga on laste ootus, et nende juhtumid jõuaksid lahenduseni oluliselt kiiremini ning neid koheldakse lapsesõbralikult mistahes etapis õigussüsteemis ja sellega haakuvates teenustes.
The aim of the article is to provide an overview of how the principles of child-friendly justice are implemented in mediation from the point of view of children. Based on the results of the study, recommendations are made for more effective implementation of the principles of child-friendly justice in cases involving children. To collect the data, 15 children who participated in the mediation were interviewed. From the experience of children, it became clear that mediation is a fair and restorative process for children and allows them to be heard, involved, participate and take their needs into account. Thus, restorative justice is implemented in Estonia on the basis of the principles of child-friendly justice, and the use of restorative justice, in turn, helps to achieve the goals of child-friendly law. However, it is the expectation of children that their cases will be resolved much faster and that they will be treated in a child-friendly manner at any stage in the legal system and related services.
